CISA Security Bill: An F for Security But an A+ for Spying | WIRED

When the Senate Intelligence Committee passed the Cybersecurity Information Sharing Act by a vote of 14 to 1, committee chairman Senator Richard Burr argued that it successfully balanced security and privacy. Fifteen new amendments to the bill, he said, were designed to protect internet users’ personal information while enabling new ways for companies and federal agencies to coordinate responses to cyberattacks. But critics within the security and privacy communities still have two fundamental problems with the legislation: First, they say, the proposed cybersecurity act won’t actually boost security. And second, the “information sharing” it describes sounds more than ever like a backchannel for surveillance.

On Tuesday the bill’s authors released the full, updated text of the CISA legislation passed last week, and critics say the changes have done little to assuage their fears about wanton sharing of Americans’ private data. In fact, legal analysts say the changes actually widen the backdoor leading from private firms to intelligence agencies. “It’s a complete failure to strengthen the privacy protections of the bill,” says Robyn Greene, a policy lawyer for the Open Technology Institute, which joined a coalition of dozens of non-profits and cybersecurity experts criticizing the bill in an open letter earlier this month. “None of the [privacy-related] points we raised in our coalition letter to the committee was effectively addressed.”


“CISA goes far beyond [cybersecurity], and permits law enforcement to use information it receives for investigations and prosecutions of a wide range of crimes involving any level of physical force,” reads the letter from the coalition opposing CISA. “The lack of use limitations creates yet another loophole for law enforcement to conduct backdoor searches on Americans—including searches of digital communications that would otherwise require law enforcement to obtain a warrant based on probable cause. This undermines Fourth Amendment protections and constitutional principles.”

Israel Denies Spying on Iran Nuclear Talks – NYTimes.com

Three top Israeli ministers on Tuesday denied a report that their intelligence services had spied on the closed-door negotiations over Iran‘s nuclear program, as tensions continued to mount between Washington and Jerusalem.

“There is no such thing as Israel spying on the Americans,” the defense minister, Moshe Yaalon, said at a pre-Passover toast, according to a transcript provided by his office. Mr. Yaalon said he had checked and found no complaint from the United States to Israeli intelligence services about such spying. “There is a strict prohibition on that,” he said.

NSA shared Americans’ private communications with Israel: Snowden

Former U.S. intelligence analyst Edward Snowden has accused the U.S. National Security Agency of routinely passing private, unedited communications of Americans to Israel, an expert on the intelligence agency said Wednesday.

James Bamford, writing in the New York Times, said Snowden told him the intercepts included communications of Arab- and Palestinian-Americans whose relatives in Israel and the Palestinian territories could become targets based on the information.

“It’s one of the biggest abuses we’ve seen,” Bamford quoted Snowden as saying.

Snowden said the material was routinely transferred to Unit 8200, a secretive Israeli intelligence organization.

Bamford cited a memorandum of understanding between the NSA and its Israeli counterpart outlining transfers that have occurred since 2009.

Leaked by Snowden and first reported by the British newspaper the Guardian, it said the material included “unevaluated and unminimized transcripts, gists, facsimiles, telex, voice and Digital Network Intelligence metadata and content.”

The Wall Street Journal‘s Adam Entous dropped a huge story Tuesday morning: Israel acquired classified US information while spying on the Iranian nuclear negotiations, and leaked the stolen information about the emerging deal to American lawmakers in an attempt to sabotage the Obama administration’s outreach to Tehran.

US House Votes 348-48 To Arm Ukraine, Russia Warns Lethal Aid Will “Explode The Whole Situation” | Zero Hedge

Yesterday, in a vote that largely slid under the radar, the House of Representatives passed a resolution urging Obama to send lethal aid to Ukraine, providing offensive, not just “defensive” weapons to the Ukraine army – the same insolvent, hyperinflating Ukraine which, with a Caa3/CC credit rating, last week started preparations to issue sovereign debt with a US guarantee, in essence making it a part of the United States (something the US previously did as a favor to Egypt before the Muslim Brotherhood puppet regime was swept from power by the local army).

The resolution passed with broad bipartisan support by a count of 348 to 48.

According to DW, the measure urges Obama to provide Ukraine with “lethal defensive weapon systems” that would better enable Ukraine to defend its territory from “the unprovoked and continuing aggression of the Russian Federation.”

“Policy like this should not be partisan,” said House Democrat Eliot Engel, the lead sponsor of the resolution. “That is why we are rising today as Democrats and Republicans, really as Americans, to say enough is enough in Ukraine.”

Engel, a New York Democrat, has decided that he knows better than Europe what is the best option for Ukraine’s people – a Europe, and especially Germany, which has repeatedly said it rejects a push to give western arms to the Ukraine army, and warned that Russia under President Vladimir Putin has become “a clear threat to half century of American commitment to an investment in a Europe that is whole, free and at peace. A Europe where borders are not changed by force.

This war has left thousands of dead, tens of thousands wounded, a million displaced, and has begun to threaten the post-Cold War stability of Europe,” Engel said.

Odd, perhaps the US state department should have thought of that in a little over a year ago when Victoria Nuland was plotting how to most effectively put her puppet government in charge of Kiev and how to overthrow the lawfully elected president in a US-sponsored coup.

Then again, one glance at the Rep. Engel’s career donors provides some explanation for his tenacity to start another armed conflict and to escalate what he himself defines as a cold war into a warm one.

Cruz’s Wife Heidi to Take Unpaid Leave From Goldman – Bloomberg Business

Heidi Cruz, a managing director at Goldman
Sachs Group Inc. in Houston, has taken an unpaid leave from her
private wealth-management job to help with her husband’s
campaign for the U.S. presidency, a person familiar with the
matter said.

Ted Cruz, 44, a Republican senator from Texas, said on
Twitter early Monday morning that he plans to run for president
in the 2016 election. Heidi Cruz’s leave will last the duration
of the campaign, said the person, who asked not to be identified
speaking about Cruz’s employment.

Heidi Cruz, 42, a Harvard Business School graduate who
worked in President George W. Bush’s administration, joined
Goldman Sachs in 2005 and was promoted to managing director, the
firm’s second-highest rank, in 2012. She serves as regional head
of the Houston office in the private wealth-management unit,
which serves individuals and families who have on average more
than $40 million with the firm.

Disciplined nuclear officers tops 16

The Air Force has fired or disciplined at least 16 nuclear missile commanders or senior officers for misconduct and other failings over the past year and a half, reflecting turmoil in arguably the military’s most sensitive mission.

Another who quit of his own accord lamented upon leaving, “We let the American people down on my watch.”

The latest to be dismissed this week: a colonel accused of “cruelty and maltreatment” of a subordinate and a missile squadron commander found to have illegally discriminated against women under his command. In addition to those actions Monday, another senior officer was administratively disciplined but not removed from command.

This string of leadership lapses has beset a force that remains central to American defense strategy but in some respects has been neglected. The force of 450 Minuteman 3 nuclear missiles is primed to unleash nuclear devastation on a moment’s notice.

Defense Secretary Chuck Hagel is expected soon to announce the results of an independent review of problems in the nuclear force.

outlets broadcasting around the globe. All of that changed effective July 2, when the Broadcasting Board of Governors (BBG) was given permission to let US households tune-in to hear the
type of programming that has previously only been allowed in outside nations.

COLD WAR

But business concerns may not be the main driver of this Saudi oil policy. Instead, the Saudis may be flexing their muscular dominance of the world’s oil markets to advance geopolitical interests, from helping the energy-dependent military government of Egypt — a Saudi ally — to undermining the adversarial regimes in Syria and Iran as well as Russia, which has emerged as a key ally for those two embattled governments.

While falling oil prices certainly do hurt Saudi Arabia, the Saudis with their vast financial reserves are well-positioned to withstand the economic pain. That is less the case with Russia and Iran, both heavily invested in the defense of Bashar al-Assad’s Syrian regime. In other words, the Saudis may see the precipitous drop in oil prices as a weapon in the broader regional Shiite-Sunni proxy war, with Saudi Arabia leading the Sunni side versus Shiite-ruled Iran.

The depressed oil prices also dovetail with the Obama administration’s geopolitical interests by putting the squeeze on Russia and Iran as the West seeks to consolidate its control over Ukraine and tries to force Iran to capitulate in talks over its nuclear program.

But the Saudi geopolitical calculation to sustain record production above 9.5 million barrels per day is probably most directed at Syria where the Saudis have financed the Sunni-led campaign to overthrow Assad, who largely represents Alawite, Shiite, Christian and other minorities. By toppling Assad and replacing him with a Sunni-dominated government, Saudi Arabia would deal a severe blow to Iran and the region’s Shiites.

Thus, Saudi Arabia is willing to resist pressure from its partners in the Organization of Petroleum Exporting Countries in order to advance what the Saudis see as their broader regional interests. For Riyadh, the self-inflicted economic pain is acceptable as long as it contributes to the broader imperative of inflicting pain on Assad and his backers.

Voters legalize recreational pot in Oregon

Oregon becomes the third U.S. state to legalize recreational pot. With two-thirds of precincts reporting, legal pot lead the race by eight percentage points, 54 to 46.

Polls showed Measure 91 was extremely close heading into Election Day.

Opinions on the measure varied by age. The measure had support from 56 percent of voters under age 35, but only 30 percent support from voters older than 65, polls showed.

“It’s always an uphill battle to win a marijuana legalization initiative in a year like this, when young people are so much less likely to vote, which makes today’s victory all the sweeter,” said Ethan Nadelmann, executive director of the Drug Policy Alliance. “The pace of reform is accelerating, other states are sure to follow, and even Congress is poised to wake from its slumber.”

Under the measure, Oregonians 21 and older will be able to possess and smoke marijuana starting July 1 of 2015.

Voters in Alaska, Oregon, and the District of Columbia voted to legalize marijuana for recreational use Tuesday, following in the footsteps of Colorado and Washington, which legalized the drug in 2012. A ballot measure to legalize marijuana for medical purposes failed in Florida, the Associated Press reports, where voters failed to meet the 60 percent threshold needed to pass a constitutional amendment.

NSA is CRAZY

Video of NSA leaker Edward Snowden surfaced late Friday. Snowden was last seen on video back in June, when he appears on camera for The Guardian discussing the reasons for releasing the details of the NSA’s surveillance programs. Since then, Snowden received asylum in Russia and just recently was awarded the Sam Adams Associates for Integrity in Intelligence award.

The Washington Post is out with the latest revelations from the Snowden leaks and it shows that the NSA relies on foreign telcos and “allied” intelligence agencies to scoop up data on email contact lists and instant messaging buddy lists to help build its giant database of connections.

And here’s the big problem: because all of this information is collected overseas, rather than at home, it’s not subject to “oversight” (and I use that term loosely) by the FISA court or Congress. Those two only cover oversight for domestic intelligence. The fact that the NSA can scoop up all this data overseas is just a bonus.

The latest revelations about the NSA’s collection of buddy lists and email address books pointed out that those issues weren’t covered by Congressional oversight, since they happened overseas. When the Washington Post questions Feinstein’s office about this, a senior staffer seemed unconcerned, mentioning that perhaps they should be asking questions about it

David Cameron has encouraged a Commons select committee to investigate whether the Guardian has broken the law or damaged national security by publishing secrets leaked by the National Security Agency whistleblower Edward Snowden.

“Glenn Greenwald, the thorn in the proverbial back of NSA and its colonial cousin GCHQ is leaving the Guardian to start his own news organization. Greenwald said ‘My partnership with the Guardian has been extremely fruitful and fulfilling: I have high regard for the editors and journalists with whom I worked and am incredibly proud of what we achieved. The decision to leave was not an easy one, but I was presented with a once-in-a-career dream journalistic opportunity that no journalist could possibly decline. Because this news leaked before we were prepared to announce it, I’m not yet able to provide any details of this momentous new venture, but it will be unveiled very shortly.’”

Journalists Jeremy Scahill and Laura Poitras will be working with Glenn Greenwald on a new media venture funded by billionaire eBay founder Pierre Omidyar, according to sources familiar with the matter.

Omidyar Network is a philanthropic investment firm dedicated to harnessing the power of markets to create opportunity for people to improve their lives. Established in 2004 by eBay founder Pierre Omidyar and his wife Pam, the organization invests in and helps scale innovative organizations to catalyze economic, social, and political change. To date, Omidyar Network has committed more than $270 million to for-profit companies and nonprofit organizations that foster economic advancement and encourage individual participation across multiple investment areas, including property rights, government transparency, and social media.

Army General Keith Alexander’s eight-year tenure was rocked this year by revelations contained in documents leaked by former NSA contractor Edward Snowden about the agency’s widespread scooping up of telephone, email and social-media data.

Alexander has formalized plans to leave by next March or April, while his civilian deputy, John “Chris” Inglis, is due to retire by year’s end, according to U.S. officials who spoke on condition of anonymity.

Shutdown Showdown

Senate leaders have reached an agreement on a compromise that would fund the government until Jan. 15 and extend the debt limit until Feb. 7.

“I think it’s important for people in the Republican Party around the country not to just come in at the end and say, ‘Congress was dysfunctional,’ or ‘Congress screwed up.’ That’s too easy to do,” King said. “Say who it was. Because it wasn’t Congress. It was one person who was able to steamroll Congress and unless we target him for what he is, he’s going to do it again. So I’m hoping other Republicans will join me and start going after this guy, and say we’re not going to let it happen again.”

John McCain is clearly glad to have this government shutdown mess behind him, going on the Senate floor today shortly after the bipartisan deal was announced to say the past few weeks have been “one of the more shameful chapters” of the Senate’s history.

Sen. Ted Cruz’ hometown newspaper, the Houston Chronicle, wishes it could take back its endorsement.

The Chronicle’s editorial board, which endorsed Cruz, R-Texas, in his 2012 race, now says it misses his predecessor, former Republican Sen. Kay Bailey Hutchison.

“When we endorsed Ted Cruz in last November’s general election, we did so with many reservations and at least one specific recommendation – that he follow Hutchison’s example in his conduct as a senator,” The Chronicle said. "Obviously, he has not done so.

“Cruz has been part of the problem in specific situations where Hutchison would have been part of the solution,” the board added.

“Is there a little bit of ransom paid? I mean, there is a provision in here that requires verification for recipients of subsidies under the Affordable Care Act.”


Obama’s Curious Purge Of The Military

But Major General Michael Carey and Vice Admiral Tim Giardina (fired amidst rumors of misbehavior involving alcohol and gambling) are just the latest in a recent rash of firings in the military’s top ranks.

Are these the men standing between us and martial law? They have been fired over various things ranging from sexual harassment to lack of trust. One thing they all have in common is their combat roles. They were all commanders of combat units.

The firing of two nuclear commanders in a week adds to a body count that suggests we have either the most corrupt and incompetent general staff in history or our military is being reshaped for other purposes.

Oh no… GMO?

SEATTLE — Washington State Attorney General Bob Ferguson announced Wednesday that his office is filing a suit against the Grocery Manufacturers Association (GMA) for violation of the state’s campaign disclosure law.

Ferguson alleges the GMA skirted the rules in its $7.2 million contribution to the "No on 522″ campaign and that the association illegally collected and spent the monies while shielding the identify of its contributors.

“When Washington state voters overwhelming approved Initiative 276 in 1972, they voiced their desire for transparency and openness in elections,” Ferguson said. “Truly fair elections demand all sides follow the rules by disclosing who their donors are and how much they are spending to advocate their views.”

Who pays for Snowden’s security in Russia?

Earlier this month, Brazilian president Dilma Rousseff announced plans to create an undersea fiber-optic cable that would funnel internet traffic between South America and Europe, bypassing the US entirely.

Brazil’s president, Dilma Rousseff, has launched a blistering attack on US espionage at the UN general assembly, accusing the NSA of violating international law by its indiscriminate collection of personal information of Brazilian citizens and economic espionage targeted on the country’s strategic industries.
Rousseff’s angry speech was a direct challenge to President Barack Obama, who was waiting in the wings to deliver his own address to the UN general assembly, and represented the most serious diplomatic fallout to date from the revelations by former NSA contractor Edward Snowden.

  • NSA planted bugs at Indian missions in D.C., U.N. – The Hindu

    According to a top-secret NSA document obtained by The Hindu, the NSA selected India’s U.N. office and the embassy as “location target” for infiltrating their computers and telephones with hi-tech bugs, which might have given them access to vast quantities of Internet traffic, e-mails, telephone and office conversations and even official documents stored digitally.
    Though emails sent to India’s New York mission have remained unanswered so far, an Indian diplomat told The Hindu that the NSA eavesdropping might have done “extensive damage” to India’s stand on many international issues ranging from UN Security Council reforms to peacekeeping operations. “If they could implant bugs inside communications equipment of European Union office here and tap into their communications cables as well, there is no reason to believe that they didn’t snoop on us,” said the diplomat, speaking strictly on condition of anonymity.

Economic Dissonance

“The 400 richest people in the United States have more wealth than the bottom 150 million put together,” said Berkeley Professor and former Labor Secretary Robert Reich on a recent CNNMoney panel on inequality.

Former Labor Secretary Robert B. Reich, who served in the Clinton administration, warned during an interview of the perils of widening income inequality in the United States, excessive executive compensation and the future of labor.

Reich is promoting his new documentary, “Inequality for All,” which looks at the income gap and possible solutions. The film premiered at the Sundance Film Festival in January and won a special jury prize in the documentary competition for director Jacob Kornbluth.

To put the staggering rise in income inequality another way: The incomes of the bottom 90 percent of Americans, adjusted for inflation, grew by $59 on average between 1966 and 2011, while the average income of the top 10 percent grew by $116,071 during the same period, according to an analysis by Pulitzer Prize-winning journalist David Cay Johnston.

The Treasury will only have $30 billion of cash on hand by mid-October, putting the United States on the precipice of an unprecedented default, the department said on Wednesday.

In the letter, Mr. Lew set Oct. 17 as the effective deadline for Congressional action: after that date, the country would be at severe risk of missing or defaulting on some of its payments every day going forward.

The Treasury makes more than 80 million individual payments a month. After exhausting its extraordinary measures, it would miss about 30 percent of those payments until Congress raised the ceiling again.

According to the Bipartisan Policy Center, the Treasury is facing a $12 billion Social Security payment on Oct. 23 and a $6 billion interest payment on the public debt on Oct. 31.

On Nov. 1 alone, it needs to spend $18 billion on Medicare, $25 billion on Social Security, $12 billion on military pay and veterans benefits and $3 billion on the Supplemental Security Income program.


Obamacare Showdown

Sen. Ted Cruz (R-Tex.) ended his marathon talking attack on President Obama’s health-care law Wednesday after 21 hours and 19 minutes — a feat of stamina that seems likely to complicate House GOP efforts to pass a funding bill aimed at averting a looming government shutdown.

The freshman senator ceded the floor — and got his first opportunity for a bathroom break — at noon, after running up against a deadline imposed by Senate procedural rules

Before tax credits that work like an upfront discount for most consumers, sticker-price premiums for a mid-range benchmark plan will average $328 a month nationally for an individual, comparable to payments for a new car.
