Thomas Eric Duncan, 42, the patient with the first case of Ebola diagnosed in the United States and the Liberian man at the center of a widening public health scare, died in isolation at a hospital here on Wednesday, hospital authorities said.

Mr. Duncan died at 7:51 a.m. at Texas Health Presbyterian Hospital, more than a week after the virus was detected in him on Sept. 30.

NSA is Crazy:

Exploiting phone information and location is a high-priority effort for the intelligence agencies, as terrorists and other intelligence targets make substantial use of phones in planning and carrying out their activities, for example by using phones as triggering devices in conflict zones. The NSA has cumulatively spent more than $1bn in its phone targeting efforts.

The disclosures also reveal how much the shift towards smartphone browsing could benefit spy agencies’ collection efforts.

One slide from a May 2010 NSA presentation on getting data from smartphones – breathlessly titled “Golden Nugget!” – sets out the agency’s “perfect scenario”: “Target uploading photo to a social media site taken with a mobile device. What can we get?”

The question is answered in the notes to the slide: from that event alone, the agency said it could obtain a “possible image”, email selector, phone, buddy lists, and “a host of other social working data as well as location”.

Whistleblower Edward Snowden leaked the documents about US mass surveillance. He spoke about his disclosures and his life to NDR journalist Seipel in Moscow.

“If there’s information at Siemens that’s beneficial to US national interests – even if it doesn’t have anything to do with national security – then they’ll take that information nevertheless,” Snowden said in the interview conducted in Russia, where Snowden has claimed asylum.

Snowden also told the German public broadcasting network he no longer had possession of any documents or information on NSA activities and had turned everything over to select journalists. He said he did not have any control over the publication of the information.

NSA is CRAZY

Michael Morell, who retired as deputy director of the CIA last summer, has joined CBS News as an intelligence, national security and counterterrorism contributor, the network announced this week.

The Washington Post has already identified the five big takeaways from Obama’s speech:

  1. US intelligence agencies will no longer hold Americans’ phone call records.

  2. There will, nevertheless, be some system for those records to be accessible when required.

  3. The US will no longer monitor the communications of the heads of state or government of “close friends and allies”.

  4. A new panel will be created to provide additional input into the secret court that oversees the Foreign Intelligence Surveillance Act (FISA), including privacy specialists and other non-government folks.

  5. There will be new rules to extend some of the privacy provisions applying to US citizens to foreigners, unless there’s a “compelling national security purpose”.

  6. ’The USA knows that for us spying is a crime’

“The German justice system will not stand idly by if the efforts of the NSA blithely continue here,” he told Bild newspaper on Monday.

Hours after President Barack Obama finished his speech last Friday on proposed intelligence and surveillance reforms, the Office of the Director of National Intelligence (ODNI) declassified a number of documents from the nation’s most secretive court.

The new documents are heavily redacted orders from FISC to the FBI. These items request that the court order an entity (likely a business) to provide “tangible things” under Section 215 of the PATRIOT Act. The documents do not refer to who the target is, nor which company or organization they apply to.

“The Court understands that NSA expects that it will continue to provide on average approximately three telephone identifiers per day to the FBI,” reads a footnote in a 2007 court order (PDF) authored by FISC Judge Frederick Scullin, Jr.

We’ve put together a scorecard showing how Obama’s announcements stack up against 12 common sense fixes that should be a minimum for reforming NSA surveillance. Each necessary reform was worth 1 point, and we were willing to award partial credit for steps in the right direction. On that scale, President Obama racked up 3.5 points out of a possible 12.

Mr. Rogers said on the NBC News program “Meet the Press” on Sunday that Mr. Snowden should be seen not as a whistle-blower but as “a thief, who we believe had some help.”

Officials at both the N.S.A. and the F.B.I. have said their investigations have turned up no evidence that Mr. Snowden was aided by others.

Speaking from Moscow, where he is a fugitive from American justice, Snowden told The New Yorker, “This ‘Russian spy’ push is absurd.”

“It’s not the smears that mystify me,” Snowden told me. “It’s that outlets report statements that the speakers themselves admit are sheer speculation.” Snowden went on to poke fun at the range of allegations that have been made against him in the media without intelligence officials providing some kind of factual basis: “ ‘We don’t know if he had help from aliens.’ ‘You know, I have serious questions about whether he really exists.’ ”

Snowden went on, “It’s just amazing that these massive media institutions don’t have any sort of editorial position on this. I mean these are pretty serious allegations, you know?” He continued, “The media has a major role to play in American society, and they’re really abdicating their responsibility to hold power to account.”

Ellsberg is commonly looked at as the quintessential whistleblower today, but shortly after he leaked the top secret Vietnam War study, the Nixon administration made a concerted effort to paint him as a Soviet spy in the press, using anonymous quotes and non-existent ‘secret’ evidence.

The National Security Agency has collected almost 200 million text messages a day from across the globe, using them to extract data including location, contact networks and credit card details, according to top-secret documents.

The untargeted collection and storage of SMS messages – including their contacts – is revealed in a joint investigation between the Guardian and the UK’s Channel 4 News based on material provided by NSA whistleblower Edward Snowden.

The documents also reveal the UK spy agency GCHQ has made use of the NSA database to search the metadata of “untargeted and unwarranted” communications belonging to people in the UK.

The NSA program, codenamed Dishfire, collects “pretty much everything it can”, according to GCHQ documents, rather than merely storing the communications of existing surveillance targets.

The NSA has made extensive use of its vast text message database to extract information on people’s travel plans, contact books, financial transactions and more – including of individuals under no suspicion of illegal activity.

NSA is CRAZY

Since 2010, the National Security Agency has been exploiting its huge collections of data to create sophisticated graphs of some Americans’ social connections that can identify their associates, their locations at certain times, their traveling companions and other personal information, according to newly disclosed documents and interviews with officials.

The policy shift was intended to help the agency “discover and track” connections between intelligence targets overseas and people in the United States, according to an N.S.A. memorandum from January 2011. The agency was authorized to conduct “large-scale graph analysis on very large sets of communications metadata without having to check foreignness” of every e-mail address, phone number or other identifier, the document said.

Over the weekend, investigative reporter Jeremy Scahill told an audience in Brazil that he and Guardian journalist Glenn Greenwald are working on a project involving “how the National Security Agency plays a significant, central role in the U.S. assassination program.”

We know a bit about the NSA’s connection to America’s global capture/kill machine already.

In the 2010 report “Top secret America,” Dana Priest and Will Arkin of The Washington Post reported that the NSA provided the capture/kill squads of Joint Special Operations Command (JSOC) with a huge advantage after the signals intelligence agency “learned to locate all electronic signals in Iraq.”

After his release from custody Sept. 20, Nacchio told the Wall Street Journal that he feels “vindicated” by the content of the leaks that show that the agency was collecting American’s phone records.

Nacchio was convicted of selling of Qwest stock in early 2001, not long before the company hit financial troubles. However, he claimed in court documents that he was optimistic about the firm’s ability to win classified government contracts — something they’d succeeded at in the past. And according to his timeline, in February 2001 — some six months before the Sept. 11 terrorist attacks — he was approached by the NSA and asked to spy on customers during a meeting he thought was about a different contract. He reportedly refused because his lawyers believed such an action would be illegal and the NSA wouldn’t go through the FISA Court. And then, he says, unrelated government contracts started to disappear.

  • Government shutdown won’t shut down NSA spying

    On Friday, the Defense Department released its plans for dealing with a potential shutdown. In a memo, intelligence and surveillance programs were listed as essential duties of the department not be affected by a shutdown.

What we’re seeing is the collapse of institutional Republican power. It’s not so much about Boehner. It’s things like the end of earmarks. They move away from Tom DeLay and they think they’re improving the House, but now they have nothing to offer their members. The outside groups don’t always move votes directly but they create an atmosphere of fear among the members. And so many of these members now live in the conservative world of talk radio and tea party conventions and Fox News invitations.

One of the biggest problems for lobbyists on Capitol Hill on day one of the shutdown was simply getting into the congressional office buildings for the access they need with lobbyists and staff. Massive lines formed Tuesday outside the House and Senate office buildings because the shutdown forced the Capitol complex to reduce the number of open entrances. Even after the morning rush of staffers arriving for work was over, it was common to see lines of nearly 100 people waiting to get into the congressional office buildings. … [David Urban, a lobbyist with the American Continental Group] – ‘being a good lobbyist,’ he joked – [said:] ‘I had one of the staffers come pick us up and he drive us into the garage’ … bypassing the security lines. … ‘I went to a 7:45 a.m. breakfast on the Hill this morning with two congressmen — it was packed and they were on time,’ said Brian Johnson, a tax and trade lobbyist at the American Petroleum Institute. ‘With long lines at all the congressional buildings, I’m thankful I’ve built relationships where folks on the Hill will just take a call — most of them, that is.’

“We have not made the required $5.6 billion Retiree Health Benefits prefunding payment due Sept. 30, 2013,” wrote USPS spokeswomen Patricia Licata in an email to CNNMoney. She added that the default has absolutely nothing to do withthe federal government shutdown. “We have been saying for several months that we will be defaulting on this payment. This is the third time we have [done so],” Licata wrote.

Postal officials have long complained about a Congressional mandate that requires them to set aside billions of dollars for a retiree health care fund each year. The Postal Service also defaulted on these prefund payments last year. In fiscal year 2012, the Postal Service lost a total of $15.9 billion, including $11.1 billion in defaulted payments that it owes to prefund health benefits for retirees.

Who pays for Snowden’s security in Russia?

Earlier this month, Brazilian president Dilma Rousseff announced plans to create an undersea fiber-optic cable that would funnel internet traffic between South America and Europe, bypassing the US entirely.

Brazil’s president, Dilma Rousseff, has launched a blistering attack on US espionage at the UN general assembly, accusing the NSA of violating international law by its indiscriminate collection of personal information of Brazilian citizens and economic espionage targeted on the country’s strategic industries.
Rousseff’s angry speech was a direct challenge to President Barack Obama, who was waiting in the wings to deliver his own address to the UN general assembly, and represented the most serious diplomatic fallout to date from the revelations by former NSA contractor Edward Snowden.

    According to a top-secret NSA document obtained by The Hindu, the NSA selected India’s U.N. office and the embassy as “location target” for infiltrating their computers and telephones with hi-tech bugs, which might have given them access to vast quantities of Internet traffic, e-mails, telephone and office conversations and even official documents stored digitally.
    Though emails sent to India’s New York mission have remained unanswered so far, an Indian diplomat told The Hindu that the NSA eavesdropping might have done “extensive damage” to India’s stand on many international issues ranging from UN Security Council reforms to peacekeeping operations. “If they could implant bugs inside communications equipment of European Union office here and tap into their communications cables as well, there is no reason to believe that they didn’t snoop on us,” said the diplomat, speaking strictly on condition of anonymity.

Economic Dissonance

“The 400 richest people in the United States have more wealth than the bottom 150 million put together,” said Berkeley Professor and former Labor Secretary Robert Reich on a recent CNNMoney panel on inequality.

Former Labor Secretary Robert B. Reich, who served in the Clinton administration, warned during an interview of the perils of widening income inequality in the United States, excessive executive compensation and the future of labor.

Reich is promoting his new documentary, “Inequality for All,” which looks at the income gap and possible solutions. The film premiered at the Sundance Film Festival in January and won a special jury prize in the documentary competition for director Jacob Kornbluth.

To put the staggering rise in income inequality another way: The incomes of the bottom 90 percent of Americans, adjusted for inflation, grew by $59 on average between 1966 and 2011, while the average income of the top 10 percent grew by $116,071 during the same period, according to an analysis by Pulitzer Prize-winning journalist David Cay Johnston.

The Treasury will only have $30 billion of cash on hand by mid-October, putting the United States on the precipice of an unprecedented default, the department said on Wednesday.

In the letter, Mr. Lew set Oct. 17 as the effective deadline for Congressional action: after that date, the country would be at severe risk of missing or defaulting on some of its payments every day going forward.

The Treasury makes more than 80 million individual payments a month. After exhausting its extraordinary measures, it would miss about 30 percent of those payments until Congress raised the ceiling again.

According to the Bipartisan Policy Center, the Treasury is facing a $12 billion Social Security payment on Oct. 23 and a $6 billion interest payment on the public debt on Oct. 31.

On Nov. 1 alone, it needs to spend $18 billion on Medicare, $25 billion on Social Security, $12 billion on military pay and veterans benefits and $3 billion on the Supplemental Security Income program.

In Ireland, where low corporate taxes have been an economic development tool for many years, the government said it had not made a special tax deal with Apple. Media Shield Law has Flaws

The White House has asked Sen. Chuck Schumer (D-N.Y.) to reintroduce a press shield law, White House officials said Wednesday.

The move comes after questions were raised about the seizure of Associated Press phone records by the Justice Department as part of a national security leak investigation.

White House press secretary Jay Carney said Wednesday that Obama welcomes the reintroduction of the shield bill.

As a Senator, Obama was a vocal supporter of a robust shield
law; he co-sponsored a bill in 2007 and campaigned on the issue in
2008
,” Timm wrote. “But when the Senate moved to pass the
bill as soon as Obama came into office, his administration abruptly
changed course and opposed the bill, unless the Senate carved out
an exception for all national security reporters
.”

For the Freedom of the Press Foundation, Timm wrote this week
that the latest version of the shield law wouldn’t do much more.
Under the Sept. 2009 request sent from the White House, the shield
law once supported by Pres. Obama would include an exception where
journalists could be subpoenaed if it means national security is at
risk.

Now, it’s important to remember: virtually the only time the
government subpoenas reporters, it involves leak investigations
into stories by national security reporters. So it’s hard to see
how this bill will significantly help improve press freedom
,”
wrote Timm. “Worse, there’s a strong argument that passing the
bill as it ended in 2010 will weaken rights reporters already have
and make it easier for the government to get sources from
reporters
.”

The difference is that instead of DOJ unilaterally making
that determination
,” the Justice Department would "have to
convince a judge that this was the case,"

Friend of the Boston Bomber Older Brother Killed by FBI

Ibragim Todashev, the man shot dead last night by an FBI agent in Orlando, Florida, had been acquainted with deceased Boston Marathon attacker Tamerlan Tsarnaev at a mixed martial arts center near Boston, according to a source briefed on the ongoing marathon bombing investigation. Todashev had Tsarnaev’s phone number in his cell phone, the source said.

Dead Boston bombing suspect Tamerlan Tsarnaev and another man — who was killed by the FBI on Wednesday — murdered three people in Massachusetts after a drug deal went wrong in 2011, law enforcement sources tell NBC News.

Breaching protocol, a Russian official let a name slip during an interview with Interfax, the state news agency.

The FSB agent told the news agency that last year, another embassy secretary was expelled from Russia for recruiting attempts. That case wasn’t made public, the agent said, but the U.S. was warned.
“We hoped our American colleagues would hear us, given that we also presented to them precise information about CIA officers making recruitment attempts in Moscow and who exactly was doing that,” the FSB agent said.

Drone Update

The Obama administration is handing control of some of its counterterrorism operations that previously fell into the hands of the CIA over to the Pentagon. The controversial drone program used by the CIA to target suspected terrorists has attracted a fair share of criticism as of late, and moving some of its operations over to the Department of Defense will allow Congress to have some oversight. Drone strikes in Yemen will fall into the hands of the Armed Forces while those that occur in Pakistan will continue to be controlled by the CIA.

WASHINGTON — One day before President Obama is due to deliver a major speech on national security, his administration on Wednesday formally acknowledged that the United States had killed four American citizens in drone strikes in Yemen and Pakistan.

The letter also said that the United States had killed three other Americans: Samir Khan, who was killed in the same strike; Mr. Awlaki’s son Abdulrahman al-Awlaki, who was also killed in Yemen; and Jude Mohammed, who was killed in a strike in Pakistan.

“These individuals were not specifically targeted by the United States,” Mr. Holder wrote.
