With Microsoft proudly declaring its .NET runtime open source, a colleague and I decided to look at the licensing aspects. One part, the MIT licence, is straightforward, but there’s also a patent promise. The first two-thirds of the first sentence seems to announce good news about Microsoft not suing people. Then the conditions begin. It seems Microsoft can’t yet bring itself to release something as free software without retaining a patent threat to limit how those freedoms can be exercised. U.S. Supreme Court: GPS Trackers Are a Form of Search and Seizure — The Atlantic

The Supreme Court clarified and affirmed that law on Monday, when it ruled on _Torrey Dale Grady v. North Carolina, _before sending the case back to that state’s high court. The Court’s short but unanimous opinion helps make sense of how the Fourth Amendment, which protects against unreasonable search and seizure, interacts with the expanding technological powers of the U.S. government.

“It doesn’t matter what the context is, and it doesn’t matter whether it’s a car or a person. Putting that tracking device on a car or a person is a search,” said Jennifer Lynch, a senior staff attorney at the Electronic Freedom Foundation (EFF).

In this case, that context was punishment. Grady was twice convicted as a sex offender. In 2013, North Carolina ordered that, as a recidivist, he had to wear a GPS monitor at all times so that his location could be monitored. He challenged the court, saying that the tracking device qualified as an unreasonable search.

North Carolina’s highest court at first ruled that the tracker was no search at all. It’s that decision that the Supreme Court took aim at today, quoting the state’s rationale and snarking:

FCC Chairman Tom Wheeler: This Is How We Will Ensure Net Neutrality

After more than a decade of debate and a record-setting proceeding that attracted nearly 4 million public comments, the time to settle the Net Neutrality question has arrived. This week, I will circulate to the members of the Federal Communications Commission (FCC) proposed new rules to preserve the internet as an open platform for innovation and free expression. This proposal is rooted in long-standing regulatory principles, marketplace experience, and public input received over the last several months.

Broadband network operators have an understandable motivation to manage their network to maximize their business interests. But their actions may not always be optimal for network users. The Congress gave the FCC broad authority to update its rules to reflect changes in technology and marketplace behavior in a way that protects consumers. Over the years, the Commission has used this authority to the public’s great benefit.

AT&T seems resigned to the near-certainty that the Federal Communications Commission will reclassify broadband as a common carrier service in order to enforce net neutrality rules. But it isn’t going to let the decision stand without a legal challenge, and the company is already telling the world what it’s going to argue in court.

“I have no illusions that any of this will change what happens on February 26,” when the FCC is expected to vote, AT&T Federal Regulatory VP Hank Hultquist wrote in a blog post yesterday. “But when the FCC has to defend reclassification before an appellate court, it will have to grapple with these and other arguments. Those who oppose efforts at compromise because they assume Title II rests on bullet proof legal theories are only deceiving themselves.”

Toshiba releases super-secure Encrypted USB Flash Drive with hardware-based encryption

“Available in 4GB ($95), 8GB ($112), 16GB ($140) and 32GB ($200) capacities, the Toshiba Encrypted USB Flash Drive uses a built-in mini-keyboard to authenticate access, incorporating a rechargeable battery so the user can enter a secure code before plugging into a USB port. Users simply enter their secure PIN and plug the drive into any USB 2.0 port on a compatible device. Once access is granted, the drive ‘unlocks’ the media, permitting clearance to all of the content stored on the drive. When the drive is removed from a USB port, the drive automatically re-locks and encrypts the stored media”, says Toshiba.

Serious bug in fully patched Internet Explorer puts user credentials at risk | Ars Technica

A vulnerability in fully patched versions of Internet Explorer allows attackers to steal login credentials and inject malicious content into users’ browsing sessions. Microsoft officials said they’re working on a fix for the bug, which works successfully on IE 11 running on both Windows 7 and 8.1.

The vulnerability is known as a universal cross-site scripting (XSS) bug. It allows attackers to bypass the same origin policy, a crucially important principle in Web application models that prevents one site from accessing or modifying browser cookies or other content set by any other site. A proof-of-concept exploit published in the past few days shows how websites can violate this rule when people use supported versions of Internet Explorer running the latest patches to visit maliciously crafted pages.

Unfortunately, Apple has just been booted out of court. As Ars Technica explains, the federal judge overseeing the Texas case ruled that Apple\’s motion only applies to seven specific app maker defendants — and Lodsys has just reached settlements with all seven.

Martha Stewart files lawsuit against Lodsys following patent infringement accusations | The Verge

As reported by GigaOm_, _Martha Stewart Living Omnimedia (MSLO) has filed a complaint in a Wisconsin federal court against Lodsys. The patent trolling company had apparently contacted Stewart\’s corporation, claiming that four of her iPad magazines infringed on a number of Lodsys patents and asking for $5,000 for each offending magazine to license the allegedly infringing technology. Unlike the small app developers that Lodsys typically preys on, however, Stewart\’s company isn\’t interested in playing ball. The civil action filed this week asks the court for a \”declaratory judgement\” against Lodsys — MSLO wants the court to affirm that none of its iPad magazines infringe upon any of Lodsys\’ patents.

The Personal Audio lawsuit that is furthest along is its case against CBS, NBC, HowStuffWorks, and TogiNet. It\’s scheduled for trial in 2014. TogiNet, the least-known defendant in that group, is based in Tyler, Texas. It seems likely that the company was added to Personal Audio\’s litigation to maintain venue in the Eastern District of Texas.

In May, the Electronic Frontier Foundation had a successful fund-raiser to fight Personal Audio\’s podcasting patent at the US Patent and Trademark Office. \”We\’re preparing a petition challenging the so-called \’podcast\’ patent and will be filing it soon,\” said EFF attorney Daniel Nazer.

After Realmac Software had released Clear for iOS 7 as a new paid app, the outcry from existing users quickly made them change their mind about the pricing model. Now they are offering the iOS 7 upgrade for free to existing Clear users on the iPhone, while only charging for the new universal app. This in turn caused other developers to complain about Realmac Software for giving in and participating in the downward price spiral.

Gawker has learned that a much-hailed partnership between two of the most prominent players in Bitcoin, Mt. Gox and CoinLab, has devolved into a nasty $75 million lawsuit, which appears to be by far the biggest Bitcoin-related lawsuit ever.

In April, $1 billion worth of bitcoins was traded across all exchanges, according to an aside in the complaint bitcoin startup Coinlab just filed against the world\’s largest bitcoin exchange, Mt.Gox. Just a month prior, only $60 million in bitcoin was traded, estimates Jeremy Liew, a managing director at Lightspeed Venture Partners.
